AN ORDINANCE TO AMEND CHAPTER 198 TO ESTABLISH REGULATIONS
RELATED TO THE SALE, STORAGE AND CHARGING OF LITHIUM-ION BATTERIES
Summary: This Ordinance amends Chapter 198 of the Town Code of West New York to regulate the sale, storage, and charging of lithium-ion batteries, prohibiting the sale of second- use and unregulated batteries, setting safety and storage requirements for Retail Stores and Specialized Bike Retailers, restricting charging practices, and prohibiting storage or charging in multi-family common areas, with civil penalties for violations and enforcement by the Fire Prevention Bureau and Department of Public Safety. The Ordinance includes standard severability and repealer provisions and shall take effect upon passage and publication as
required by law.
